Neuriko — Learning your way

§ 1. General Provisions
- These Terms of Service (hereinafter: "Terms") set out the rules for using the Neuriko educational platform (hereinafter: "Platform", "Service") available at neuriko.pl and in the mobile app (if applicable).
- The service provider is Jakub Tomczyk running an unregistered business within the meaning of Art. 14 of the Act of March 6, 2018 — Entrepreneurs' Law (hereinafter: "Service Provider", "Neuriko", "we").
- Using the Platform implies acceptance of these Terms.
- The Service Provider reserves the right to amend the Terms in accordance with § 12.
- The Neuriko Platform is created by the team: Jakub Tomczyk (design, UX/UI, frontend), Patryk Malczyk (logic, backend, AI). The Service Provider within the meaning of these Terms is Jakub Tomczyk as a natural person running an unregistered business.
§ 2. Definitions
- User — a natural person with full legal capacity who has registered an account on the Platform;
- Parent/Guardian — a User registering an account on the Platform to use it together with a child;
- Child — a minor using the Platform under the supervision of a Parent/Guardian;
- Child's Profile — a set of educational and sensory preferences configured by the Parent;
- Parent Zone — a section of the Platform accessible after authentication, containing the management panel, AI reports, and configuration;
- Child Zone — a secure section of the Platform intended for learning, secured by a PIN lock;
- Micro-metrics — behavioral data collected during the child's interaction with the educational material (reaction time, number of attempts, emotional resilience indicators);
- AI Report — a description of the child's educational progress generated by the artificial intelligence system;
- Subscription — paid access to Platform features for a specified period;
- PIN Code — a 4-digit code securing access to the Parent Zone against unauthorized access by the child.
§ 3. Terms of Use of the Platform
- Using the Platform is only allowed for persons over 18 years of age. A child uses the Platform exclusively under the supervision of a Parent/Guardian who has an account.
- Registration requires providing an e-mail address and creating a password. Registration and authentication are provided through Clerk Inc.
- The Parent/Guardian declares that they have read and accept the contents of these Terms and the Privacy Policy.
- The child's use of the Platform implies the Parent's/Guardian's consent to the processing of data regarding the child's interaction with the Platform for the purpose of providing educational services.
- It is forbidden to share login credentials with third parties. The Parent/Guardian is responsible for all actions taken using their account.
§ 4. Description of Services
- The Neuriko Platform is a sensory-friendly, safe, and personalized educational platform designed for children on the autism spectrum (ASD) and with ADHD.
- The main functionalities of the Platform include:
- Personalized onboarding configured by the Parent (number range, visual theme, sensory sensitivity);
- Math lessons based on the CRA (Concrete-Representational-Abstract) methodology;
- No pressure on results — no negative feedback, time limits, or grading;
- Sensory safety — muted color palette, quiet sounds, minimalist interface;
- AI diagnostics (Mistral AI) generating progress reports and recommendations for the Parent and therapists;
- Parent Zone locked with a PIN code;
- Progress panel with educational micro-metrics.
- The Service Provider reserves the right to expand the functionalities of the Platform with additional subject modules (e.g., foreign languages, logic, nature) without needing to change these Terms.
§ 5. Subscriptions and Payments
- Using certain features of the Platform may require purchasing a subscription. Detailed plans and pricing are available on the Platform after logging in.
- The subscription renews automatically for the next billing period unless the User cancels it before the end of the current period.
- Payments are processed via secure payment systems. The Service Provider does not store full payment card data.
- According to the Consumer Rights Act, a User who is a consumer has the right to withdraw from the contract within 14 days of its conclusion without giving any reason. A model withdrawal form is available at: kontakt@neuriko.pl.
- The Service Provider operates an unregistered business based on Art. 14 of the Entrepreneurs' Law. The revenue from this activity does not exceed the limit specified in this provision. In the event the limit is exceeded, the Service Provider undertakes to register a business activity in CEIDG and update these Terms.
§ 6. Intellectual Property Rights
- All content on the Platform (including software, educational content, graphics, animations, interface, AI-generated materials) is protected by copyright and belongs to the Service Provider or its licensors.
- The User is granted an irrevocable, limited, non-exclusive license to use the Platform for educational purposes solely for the needs of the child under their care.
- It is forbidden to:
- Copy, modify, decompile, or reverse engineer the Platform;
- Redistribute educational content outside the Platform;
- Use AI reports for purposes other than supporting the education of the child under the Parent's care;
- Use automated tools (bots, scrapers) to download data from the Platform.
§ 7. Limitation of Liability
- The Platform is provided "as is". The Service Provider does not guarantee uninterrupted operation of the Platform or the absence of errors.
- AI reports and educational recommendations are solely for informational and auxiliary purposes and do not constitute clinical diagnosis, medical advice, or therapeutic advice. The Service Provider is not liable for decisions made based on AI reports.
- The Service Provider makes every effort to ensure that the educational content is factually correct, but does not guarantee it is entirely error-free.
- The Service Provider is liable for damages to the User only in cases of gross negligence or intentional action, in accordance with applicable law.
- The total liability of the Service Provider due to the use of the Platform cannot exceed an amount equal to twelve times the monthly subscription fee paid by the User, or, in the case of Users using the free version, the amount of 100 PLN.
§ 8. Personal Data Protection
Issues regarding the processing of personal data are regulated by the Privacy Policy, which is an integral part of these Terms.
§ 9. Child Safety on the Platform
- The Platform is designed in accordance with the Safe Learning concept — no pressure on results, sensory safety, no negative feedback.
- The Child Zone is separated from the Parent Zone by a PIN lock (4-digit code), preventing the child from accidentally leaving the safe learning zone.
- The Platform does not contain ads, microtransaction mechanisms accessible to the child, or external links in the Child Zone.
- The Service Provider uses technical measures to prevent overstimulation: muted color palette, quiet sounds, no time pressure.
- The User (Parent/Guardian) is obliged to supervise the child's use of the Platform and not to share the PIN code with the child.
§ 10. Maintenance Windows
- The Service Provider reserves the right to maintenance windows necessary for the maintenance, update, and development of the Platform.
- The Service Provider will endeavor to conduct maintenance during periods of lowest load and communicate them in advance.
- In the event of maintenance lasting longer than 48 hours during a subscription period, the User is entitled to an extension of the subscription period by the duration of the downtime.
§ 11. Termination of Agreement and Account Deletion
- The User can delete their account and terminate the agreement at any time via the account settings panel or by contacting kontakt@neuriko.pl.
- After deleting the account, the User's personal data and associated child profiles are deleted in accordance with the Privacy Policy (Art. 17 GDPR — right to be forgotten), unless a legal obligation requires them to be stored longer.
- The Service Provider reserves the right to terminate the agreement in the event of a gross violation of the Terms by the User, after prior notice to cease the violation.
§ 12. Changes to the Terms
- The Service Provider reserves the right to change the Terms to the extent permitted by law.
- The User will be notified of any changes to the Terms via e-mail sent to the address associated with the account, 14 days in advance.
- If the updated Terms are not accepted, the User has the right to terminate the agreement without incurring any costs.
- Continued use of the Platform after the changes to the Terms take effect is equivalent to their acceptance.
§ 13. Unregistered Business Activity
- The Service Provider operates within an unregistered business activity based on Art. 14 of the Act of March 6, 2018 — Entrepreneurs' Law.
- An unregistered business allows providing services without the need to register in CEIDG, provided that the revenue limit specified in the regulations is not exceeded.
- A User who is a consumer (within the meaning of the Civil Code) retains full consumer rights, including the right to withdraw from the contract within 14 days without giving any reason.
- In the event the revenue limit for unregistered business is exceeded, the Service Provider undertakes to register a business activity and update these Terms within 7 days from the day the limit is exceeded.
§ 14. Final Provisions
- These Terms are governed by Polish law.
- Any disputes arising from the application of these Terms will be resolved by a common court competent for the Service Provider's place of residence.
- In matters not covered by these Terms, the provisions of the Civil Code, the Consumer Rights Act, the Act on Providing Services by Electronic Means, and the GDPR provisions apply.
- The Privacy Policy is an integral part of these Terms.
